About the Firm

In 1989, Thomas F. Gardner, a licensed mechanical engineer and a member of the Louisiana Bar, founded a law firm in 1989 to serve the highly complex and technical needs of the construction industry.  What was apparent in 1989 is still true today.  The needs of the construction industry simply do not align with the traditional services provided by attorneys who have no technical background or construction industry experience.

In 1990, Tom Gardner met Douglas A. Kewley, an attorney with ten years of experience representing a major manufacturer of roofing systems.  Shortly after this meeting, Gardner & Kewley, A Professional Law Corporation was established.  Unlike most law firms, Gardner & Kewley, APLC, renders legal services to the construction community utilizing counsel with hands-on construction experience.  Gardner & Kewley represents the following types of clients:

  • Architects
  • Condominium Associations
  • Contractors and Subcontractors
  • Developers and Owners on Commercial Buildings
  • Engineers, including Electrical, Geotechnical, Mechanical, Petrochemical and Structural
  • Homeowner Associations
  • Labor Suppliers
  • Manufacturers and Suppliers, including Sales Agents and Sales Representatives
  • Payment and Performance Bond Sureties
  • Power Companies, including claims arising out of the construction of plants and of distribution facilities
  • Professional and General Liability Insurers
  • Shipyards
  • Sureties

By associating and recruiting only attorneys with education, training or experience in the construction industry, Gardner & Kewley provides its clients with counsel that are knowledgeable about how the construction industry works and who are familiar with the terminology that is unique to the industry.  The attorneys at Gardner & Kewley can read drawings and understand specifications.  Gardner & Kewley’s attorneys understand the design and construction processes from schematic design through final completion.  By employing multiple counsel with engineering and construction industry experience, combined with at least twenty-five years of construction law experience, Gardner & Kewley offers clients a unique level of expertise.

Gardner & Kewley routinely handles claims arising out of the following types of disputes:

  • Bid Bonds,
  • Bid Protests,
  • Breach of Contract,
  • Construction Defaults,
  • Construction Defects,
  • Contractor and Subcontractor Defaults,
